These Terms of Service ("Terms") govern access to and use of the ClickScales website and AI sales-agent platform (the "Service") provided by ClickScales ("we", "us"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business.

1. The Service

The Service lets businesses deploy an AI assistant that communicates with their sales leads by phone, WhatsApp, and email, qualifies leads, books meetings on the business's connected calendar, and syncs with CRM systems. Features may change as the Service evolves; we will not materially degrade core functionality of a paid plan during a paid term without notice. Service descriptions on the website are general; binding commercial terms for business customers are set in a separate service agreement.

2. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

3. Submitting your details and receiving a call from an AI agent

When you submit a "Book a demo" or contact form on the website: you agree that we may reach you back by phone call, WhatsApp, or email, including through an AI-based digital agent; calls are recorded and transcribed, and notice of this is also given at the start of the call; and you may ask at any time to stop being contacted ("remove me") — and we will comply. 4. Customer content and responsibilities

• Your data stays yours. You retain all rights to the lead data, business information, and content you provide. You grant us a limited license to process it solely to provide the Service.
• Lawful outreach. You are responsible for having a lawful basis to contact your leads by phone, WhatsApp, and email, for complying with applicable telemarketing, spam, and messaging-platform rules, and for providing any legally required notice or consent for call recording in your jurisdiction.
• AI disclosure. Where applicable law requires disclosing that a caller or correspondent is an automated agent, you are responsible for enabling and maintaining that disclosure.
• Third-party keys. Where you connect your own accounts or API keys (LLM provider, CRM, telephony, calendar, sending domain), your use of those services is governed by your agreements with those providers, and you are responsible for associated fees.

5. Acceptable use

You may not use the website or the Service to: send unlawful, deceptive, or harassing communications; submit false details or a third party's details without authorization; impersonate a real person with intent to deceive; violate the rights or privacy of any person; perform automated scraping; attempt to disrupt the digital agent or probe the platform's security; resell the Service; or violate the policies of integrated platforms (including Google, Meta/WhatsApp, and telephony carriers). We may suspend accounts that put the platform, its carriers, or other customers at risk.

6. Google and other integrations

If you connect Google Calendar, our access and use of Google user data is described in our Privacy Policy and complies with the Google API Services User Data Policy, including Limited Use. You may disconnect any integration at any time; doing so may disable dependent features.

7. AI output disclaimer

The Service uses artificial intelligence. AI-generated conversation, summaries, and qualification scores may contain errors and are provided to assist — not replace — your business judgment. Metrics shown on the website (response times, conversion rates, and similar) are illustrative and are not a promise of business results. Nothing on the website constitutes legal, financial, or other professional advice.

8. Fees

Paid plans are billed as described at purchase. Usage-based charges (such as voice minutes) are metered and billed per the plan. Fees are non-refundable except where required by law. We may change pricing with prior notice, effective from your next billing cycle.

9. Term and termination

You may stop using the Service and cancel at any time. We may suspend or terminate access for material breach of these Terms. Upon termination we delete or return Customer content as described in the Privacy Policy, except where retention is required by law.

10. Intellectual property

The website and the Service — including texts, design, logo, trademarks, software, and demos — are owned by ClickScales or its licensors. No copying, reproduction, or commercial use is permitted without prior written approval. These Terms grant no rights other than the limited right to use the Service.

11. Warranties and liability

The website and the Service are provided "as is" without warranties of any kind, express or implied, including as to continuous availability or absence of errors. To the maximum extent permitted by law, ClickScales will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, revenue, or data; and our aggregate liability under these Terms is limited to the amounts you paid us in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnity

You will indemnify ClickScales against third-party claims arising from your content, your outreach practices, or your breach of these Terms or applicable law.

13. Accessibility

We work to make the website accessible in accordance with Israeli Standard 5568 at level AA. If you encounter an accessibility issue, contact koren@clickscales.com.

14. Governing law

These Terms are governed by the laws of the State of Israel, and the competent courts of the Tel Aviv district shall have exclusive jurisdiction, without prejudice to mandatory consumer protections in your place of residence.

15. Changes

We may update these Terms from time to time; the current version published on this page is the binding one. Material changes will be notified through the Service or by email.
